Terms & Conditions

This document (the “Terms and Conditions”) sets forth the terms and conditions applicable to your use of the CampusCuisine.net website (the “Website”). By visiting the Website, you agree to the Terms and Conditions. If you do not agree to the Terms and Conditions, you should terminate your use of the Website immediately.

The Website is owned and operated by Campus Cuisine, Inc. (“Campus Cuisine”), a Georgia corporation. Campus Cuisine may, at its discretion, discontinue some or all of its operations at any time and for any reason without fault or notice to you.

Registration, Ordering and Cancellation

(a) When registering for an account on the Website, you agree to provide accurate and complete information about yourself and the child(ren) for whom you are placing an order, and to immediately update any and all information as it may change from time to time. As part of the registration process, you will be asked to create an account Login, consisting of a Username and Password. You are solely responsible for all activity associated with your account. You agree to notify Campus Cuisine immediately in the event of unauthorized use of your account.

(b) All meals for a given day must be ordered no later than noon ( EST) the previous day.

(c) Meal prices are subject to change without notice. Once your order is complete, you will receive a confirmation email/receipt for your records, which you agree to review immediately. In the event of any error, please contact kathryn@campuscuisine.net immediately.

(d) It is the responsibility of each individual to manage their orders. Meal orders may be cancelled up to the ordering deadline or noon (EST) the day before lunch is scheduled for delivery. In the event of a timely cancellation for any reason, you will receive an account credit, redeemable for future orders during the same school year. Cancellations are not accepted after noon (EST) the day before and will not be entitled to a credit. Credits are non-refundable and expire at the end of each school year.

2. Indemnification, Disclaimers and Limitation of Liability

(a) You acknowledge that it is your sole responsibility to take any actions necessary to protect against exposure to food allergens. You agree to indemnify and hold Campus Cuisine, its owners, agents, licensees, assignees, employees, affiliates, members, parents, attorneys, subsidiaries and related companies, the directors, officers, agents of any of the foregoing, and their successors and assigns, free and harmless from any and all claims, damages, liabilities, costs and expenses, including attorneys’ fees, in connection with your use of the Website and all services provided by Campus Cuisine or your breach of any of these Terms, including but not limited to any injury to person or property arising from the use of the Website or in connection with meals provided by Campus Cuisine.

(b) Campus Cuisine cannot be held liable or responsible in any way for any event that results from use of any information or services on the Website, not limited to financial losses or damage to hardware, software, or other equipment. You completely release, indemnify, hold harmless and absolve Campus Cuisine of any responsibility, financial or otherwise, for use of the Website. Campus Cuisine will use reasonable efforts to keep the website service available on an ongoing basis. You may occasionally experience poor performance based on the need for Campus Cuisine to provide maintenance, temporary unavailability of the web or reasons beyond our control. Campus Cuisine shall not be liable for these types of failures.

(c) The Website and the services offered on the Website are provided as-is to the extent provided by law, without warranties of any kind, either express or implied, including but not limited to non-infringement, warranties of merchantability, and fitness for a particular purpose.

3. Intellectual Property

You acknowledge that the Website, and all works on the Website, are owned by or licensed to Campus Cuisine. You may not reproduce or distribute, in any way except as explicitly authorized in writing, any material found on the Website.

 

4. General

(a) Campus Cuisine reserves the right to modify these Terms and Conditions and any policies affecting the Website at any time without notice. Any modification is effective as of the posting of the change. Your continued use of the Website following such modification shall be deemed an acceptance of such modifications.

(b) These Terms and Conditions shall be governed and construed in accordance with the laws of the State of Georgia and the United States applicable to contracts to be wholly performed in Georgia. Any action based on or alleging a breach of these Terms and Conditions or otherwise relating to these Terms and Conditions shall be brought only in a state or federal court located in Fulton County, Georgia. In any such action if Campus Cuisine prevails, Campus Cuisine shall be entitled to recover its legal fees and costs.

(c) These Terms and Conditions constitute the entire agreement between you and Campus Cuisine with respect to the Website and services provided by Campus Cuisine via the Website. Failure by Campus Cuisine to enforce any provision of these Terms and Conditions shall not be construed as a waiver of any provision or right. In the event any portion of these Terms and Conditions is held unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of these Terms and Conditions shall remain in full force and effect.

(d) The headings and titles in these Terms and Conditions are for convenience only and have no legal or contractual effect.

5. Privacy Policy

(a) Campus Cuisine declares that the personal information it collects during Registration is confidential and used solely for the purpose of managing the Campus Cuisine lunch process and communication with our customers.

6. Credit Policy

The cutoff time for orders, changes and cancellations is Noon Eastern Time the day before lunch is to be delivered. If your child is sick, please notify us before 8:00am that day for a credit. You will receive a Campus Cuisine credit for any lunches cancelled. (Note: Students at Lake Country Christian are not allowed to make same day cancellations for sickness, due to school policy.) If school is closed due to the weather, we will cancel the lunches and issue credits. Credits may be used to purchase future lunches, but are not refundable and will expire at the end of the school year in June.
